THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.592 OF 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioner-A.2 seeking to quash the proceedings in crime No.309 of 2017 of Vempalli police station, Kadapa district registered for the offences punishable under Sections 406, 409, 420, 465, 468 and 472 IPC.

Heard both learned counsel for the petitionerA.2, the learned Additional Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner-A.2 would submit that the petitioner-A.2 is innocent person, and there are no allegations constituting the offences alleged in the crime, and ultimately, prays to quash the impugned proceedings.

On the other hand, the learned Additional Public Prosecutor opposed the grant of relief sought in the Criminal Petition.

In view of the contentions put forth by both sides, the point for determination is whether the proceedings in crime No.309 of 2017 of Vempalli police station, Kadapa district are liable to be quashed in respect of petitioner-A.2? 6.

The material on record reveals that the petitioner-A.2 and other accused fabricated pattadar pass books and obtained loan ofRs.7,67,000/- for the purpose of agriculture from the Co-operative Society Bank. There is

also material to show that the Co-operative Bank employees as well as outsiders colluded in sanctioning of the said loans. There are also allegations of fabricating pattadar pass book, filing the same before the Bank and obtaining the loan. The crime requires investigation. Continuation of the impugned proceedings would not be abuse of process of law. There are no circumstances to allow the present petition as prayed for. The Criminal Petition is devoid of merits and is liable to be dismissed. 7.
