HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 14368 OF 2012 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue. With the consent of both the parties the present writ petition is heard at the at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not allowing the petitioners to dig the fresh water aquaculture tanks in their lands admeasuring Ac.13.62 cents in Sy.No.1075/1 to 1075/5 situated at Pulla Village, Bhimadole Mandal, West Godavari District, as arbitrary, illegal and violative of principles of natural justice.

Though various grounds are raised by the petitioners in the Writ Petition, learned counsel for the petitioners restricts his prayer seeking a direction to the third respondent to dispose of the application dated 31.07.2009 made before the third respondent for conversion of agricultural land into fish tanks at the earliest.

Without going into merits of the case and having regard to the circumstances stated above, the Writ Petition is disposed of directing the first respondent, ie. the Collector-cum-Chairman, District Level Committee, Eluru to process the application dated 31.07.2009 made by the petitioner for conversion of agricultural land into fish tank in accordance with law, within a period six (06) weeks from the date of receipt of a copy of this order, if the same

is pending. No order as to costs.
