THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15898 of 2002 ORDER:

This Writ Petition is filed seeking to issue a writ of Certiorari calling for the records relating to and connected with I.D.No.198 of 1998 on the file of the Industrial Tribunal-cum-Labour Court, Visakhapatnam, and quash the award dated 28.3.2000 passed therein insofar as denying back wages to the petitioner during out of employment period.

Heard Sri P.Govinda Rajulu, learned counsel for the petitioner and Sri S.V.Ramana, learned standing counsel for the respondent corporation.

It has been contended by the learned counsel for petitioner that the petitioner's husband was removed from service on 6.3.1998 and challenging the same, her husband filed I.D.No.198 of 1998 before the 1st respondent-Industrial Tribunal-cum-Labour Court, Visakhapatnam. The 1st respondent-Labour Court vide orders dated 28.3.2000 directed reinstatement of the petitioner's husband with continuity of service but without back wages. Accordingly, the petitioner's husband was reinstated into service and while he was discharging his duties, he expired on 16.5.2000. Challenging the orders of the Labour Court insofar as denying back wages to her husband, the present writ petition is filed.

Considering the submissions made by the learned counsel for the petitioner, as no illegality or irregularity is pointed out in the

orders passed by the 1st respondent Labour Court, this Court cannot interfere with the orders passed by the Labour Court. Hence, there are no merits in the writ petition.

Accordingly, the Writ Petition is dismissed. No order as to costs.
