THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.2154 of 2019 ORDER:
The grievance of the petitioner is that the document presented by him for registration has been kept pending with pending registration No.P53/18 by the Sub-Registrar, Kapra, Medchal District. Sri K.Venumadhav, learned counsel for the petitioner, would inform this Court that W.P.No.40037 of 2018 was disposed by the erstwhile common High Court for the States of Telangana and Andhra Pradesh vide order dated 08.11.2018. A copy of the said order is placed on record. Perusal thereof reflects that the learned Judge disposed of the writ petition taking note of the provisions of Section 71 of the Registration Act, 1908 (for short, 'the Act of 1908').
For reasons alike as were mentioned in the aforestated order and in terms thereof, the writ petition is disposed of directing the SubRegistrar, Kapra, Medchal District, to complete the process in relation to the document kept pending with pending registration No.P-53/18. In the event the said document is found to be in order and in full compliance with the requirements of the Act of 1908, and the Indian Stamp Act, 1899, the Sub-Registrar shall complete the registration formalities and release the document after due registration. If, for any reason, he opines that the document is not registerable, he shall pass a reasoned order of refusal under Section 76 of the Act of 1908 and communicate the same to the petitioner. The exercise, one way or the other, shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
