THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 36776 OF 2012 O R D E R :

It is submitted by the learned counsel on either side that though a challenge has been made to the proceedings, dated 09.11.2012, whereby a committee has been appointed to decide the modalities for conducting secret ballet for the elections to be held in 2013, since the elections have already been conducted, the cause in this Writ Petition does not survive any longer for adjudication and hence, it has become infructuous. With this, the Writ Petition stands closed. No costs. Now, the learned counsel for the petitioners brings to the notice of this Court that various guidelines have been issued by the Supreme Court with respect to conducting the elections, which may be directed to be followed by the respondent Railways. It is needless to mention that in terms of Article 142 of the Constitution of India, law declared by the Supreme Court is binding in all respects. In that view of the matter, the respondent Railways shall follow the law declared by the Supreme Court with respect to the trade unions from time to time in its true letter and spirit, subject to its applicability.

Consequently, the miscellaneous Applications, if any shall also stand closed.
