This writ petition is filed to declare the action of the third respondent in not taking up either the interlocutory application or the suit O.S.No.A/803/2019 filed by the petitioner against the respondents 5 and 6 for perpetual injunction in respect of the agricultural land to an extent of Ac.0.20 gts in Sy.No.118 situated at Echoda Village sivar, Echoda Mandal, Adilabad District, though notices of hearing have been issued by the third respondent on 10.12.2019, 12.12.2019, 17.12.2019, 21.12.2019 and 18.01.2020, as being illegal, arbitrary and abuse of process of law. 2.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Social Welfare for respondents. 3.

It is seen from the material papers filed along with the writ petition that though the third respondent authority is ceased of the matter and has issued notices on five occasions by fixing the date of hearing, the case/matter seems to have been adjourned without being taken up for hearing.

Having regard to the fact that since the third respondent authority is ceased of the matter and has already issued notices earlier on five occasions, this Court is of the view that ends of justice would be met if a direction is issued to the third respondent authority to dispose of either the interlocutory application or the suit filed by the petitioner, within a time frame.

Accordingly, the third respondent authority is hereby directed to dispose of either the interlocutory application or to take up hearing of the

suit and dispose of the same within a period of four weeks from the date of receipt of a copy of this order.

Subject of the above observations, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
