HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.2053 OF 2020 ORDER:

The present Writ Petition is filed to declare the action of respondent Nos.3 and 4 in calling the petitioner to police station at the behest of respondent Nos.5 and 6 and threatening to handover the possession of the land in Sy. No.352/A2 admeasuring Ac.1.27 gts situated at Warangal District and thereby causing interference in the civil matters, as being illegal, arbitrary and unconstitutional. 2.

Heard Sri G. Karunakar Reddy, learned Counsel for the petitioner, learned Assistant Government Pleader for Home and Sri B. Vivekananda, learned Counsel for respondent Nos.5 and 6. 3.

Learned Assistant Government Pleader for Home, on written instructions dated 11.02.2020, submits that the wife of 6th respondent in the present Writ Petition gave a complaint to the 3rd respondent authority on 10.01.2020 wherein she stated that she is having land of Ac.1.12 gts in Sy. No.352/A, Bheemaram village, while so one Suram Bapu Reddy created fake documents and forged the signatures and tried to occupy her land, as such she requested to take necessary action. By the said written instructions, it is submitted that on receipt of the complaint, a G.D. entry was made on 10.01.2020 and enquiry was done and during enquiry informed the petitioner to produce relevant documents with regard to land in as a complaint is given against him, upon which the petitioner approached the Station House Officer and produced documents. It is further stated that after enquiry, a case is registered in Crime No.34 of 2020 under Sections 420, 468,

471, 506 IPC of Hasanparthy police station and the investigation in the matter is under progress.

Having regard to the fact that a case has been registered based on the complaint of the wife of the 6th respondent and being under investigation, no further orders need be passed in this Writ Petition except observing that the respondent police authority shall conduct investigation into the matter in accordance with law. 5.

Subject to the above observation, the Writ Petition is closed. No order as to costs.

As a sequel thereto, the miscellaneous petitions, pending if any, shall stand closed.
