HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.2480 of 2016 ORDER:

Heard.

The petitioner herein complains that though his name is consistently shown in the revenue record and he is the lawful assignee of the land admeasuring Ac.0-33 gts., in Sy.No.113/37 situated at Lingapur Village, Maddur Mandal, Warangal District, the entries in the revenue record have been changed showing the name of the 6th respondent in the place of the petitioner. Aggrieved thereby, the petitioner filed a complaint before the 3rd respondent on 29-12-2015 and the 3rd respondent called for a report from the 4th respondent. Since no action is taken, the present writ petition is filed questioning the action of the 4th respondent in changing entries in the revenue record by deleting the petitioner's name without issuing any notice. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.

It is evident from the record that on the report called for by the 3rd respondent, the 4th respondent has already sent a detailed report in Rc.No.B/1821/2015, dated 28-12-2015 and the said report is under consideration of the 3rd respondent.

Learned counsel for the petitioner states that against illegal interference by the 6th respondent, the petitioner has already filed a suit in O.S.No.280/15 before the Principal Junior Civil Judge, Jangaon and obtained an interim injunction on 14-12-2015 in I.A.No.309 of 2015 against the 6th respondent and another, which is subsisting.

It is evident from the above that the petitioner made a complaint before the 3rd respondent and the 4th respondent has already sent a report to the 3rd respondent. Hence, it is appropriate to direct the 3rd respondent to examine

the petitioner's grievance in the light of the aforesaid report and other attendant circumstances and take appropriate decision in the matter by passing a reasoned order. Status-quo existing as on today with regard to the land in question shall be maintained until the 3rd respondent takes an appropriate decision, as directed above.

The Writ Petition is, accordingly, disposed of. No costs. Miscellaneous Petitions, if any, pending shall stand closed. _______________________ VILAS V.AFZULPURKAR, J 29.01.2016 Prv
