This writ petition is filed seeking writ of mandamus declaring the action of the respondents in trying to construct a Pail (Gattu) by digging pits in front of the house of the petitioner with assessment No.1386 in Sangham Village by encroaching the way to the house of the petitioner leaving no scope to reach the house of the petitioner by taking vehicles from the main street and causing obstruction to the ingress and egress of the petitioner at the instance of the 5th respondent as illegal and arbitrary.
The grievance of the petitioner is that some pits have been dug in front of his house by the respondent authorities causing obstruction to ingress and egress to his house. Aggrieved by the same, present writ petition is filed. Heard Smt. K.Pallavi, learned counsel for the petitioner as well as Sri G.Seshadri, learned Standing Counsel for the 4th respondent. Sri G.Seshadri, learned Standing Counsel for the 4th respondent submits that without approaching the authorities and without filing an application, the petitioner straight away filed the present writ petition. Since the petitioner has not approached the competent authority by filing an application ventilating his grievance, before filing the present writ petition, writ petition is misconceived and is liable to be dismissed. Accordingly, this writ petition is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
