Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner states that she is the absolute owner of the land of an extent of Ac.3.03 cents situated in various survey numbers in Kummarilova village, Tuni Mandal, East Godavari district. She states that it is the self acquired property of her mother-in-law. The Government wanted to acquire an extent of Ac.1.24 cents for LMC Project in the year 2009 and the compensation was also settled. The case of the petitioner is that her name was not shown as one of the beneficiaries, but the amount in respect of the said property is being disbursed to some other party. In the circumstances, the petitioner got issued a notice through her counsel on 24.05.2017 for payment of compensation and, when no action was taken, the present Writ Petition is filed.

Learned Government Pleader, on the basis of written instructions, submits that the notice was received and, in view of the notice, the amount of Rs.92,31,868/-, determined under award dated 31.05.2017, is being deposited before the authority under Section 77(2) of the Act 30 of 2013 for proper adjudication. It is stated that necessary action would be taken to deposit the amount before the authority. It is also stated that compensation amount was already paid to the remaining land owners except the present writ petitioner.

In view of the same, the Writ Petition is disposed of directing the Revenue Divisional Officer, Peddapuram to refer the matter to the competent authority and deposit the amount of compensation in respect

of the disputed land before the said authority within a period of one month from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
