This is a creditor's winding up petition filed under Section 433 and 434 of the Companies Act, 1956, seeking winding up of the respondent-Company.

When the matter is taken up for hearing, learned counsel appearing on both sides submits that the amount due has been paid and the matter has been settled and seeks that the company petition may be closed. A memo to the said effect has also been filed. Recording the said submission, the Company Petition is closed. As a sequel, the miscellaneous petitions, if any, shall stand closed in the light of this final order.
