HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.2165 of 2019 ORDER:

This writ petition is filed seeking a Writ of Mandamus declaring the action of respondents in not considering the case of petitioner for upgradation to the post of Superintendent Grade-I in terms of G.O.Ms.No.66, dated 30.01.1991, G.O.Ms.No.803, dated 19.09.2002 and Govt Memo dated 10.08.2018 as illegal and arbitrary. Heard Mr.K.Papi Reddy, learned counsel for petitioner and the learned Government Pleader for Services-II. It has been contended by the petitioner that he was initially appointed as Junior Assistant in the year 1997 and later he was promoted as Senior Assistant in the year 2000 and thereafter as Superintendent in the year 2011. He has undergone training of Mandal Revenue Officer for a period of two years successfully and as per G.O.Ms.No.66 dated 30.01.1991 and G.O.Ms.No.803 dated 19.09.

2002, the Superintendent, who has undergone Mandal Revenue Officer's training has to be re-designated as Superintendent Grade-I. But, the respondents are not considering his case for upgradation to the post of Superintendent Grade-I. Therefore, the counsel for petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the case of petitioner for upgradation to the post of Superintendent Grade-I in terms of G.Os., referred supra. Learned Government Pleader appearing for respondents has contended that the case of the petitioner will be considered in terms of GOs., referred supra and appropriate orders would be passed.

This Court, having considered the rival submissions, is of the considered view that the writ petition can be disposed of directing the respondents to consider the case of the petitioner for upgradation to the post of Superintendent Grade-I in terms of G.O.Ms.No.66, dated 30.01.1991, G.O.Ms.No.803, dated 19.09.2002 and Govt Memo dated 10.08.2018 and also in accordance with the existing Rules.

With the above observations, the writ petition is disposed of. No order as to costs.
