THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.7022 of 2016 ORDER:
Petitioner's grievance is that petitioner had presented a document for registration before the 5th respondent, but he refused to register it on the ground that the land in respect of which the registration was sought is included in Prohibited Lands List communicated by 4th respondent and he also refused to receive the document presented by petitioner.
2. Learned Government Pleader for Revenue states that 5th respondent will receive the document presented by petitioner for registration in respect of the subject land and if he does not wish to register it, he will pass a reasoned order why he does not want to register it under Section 71 of the Registration Act, 1908 (for short "the Act") and communicate it to the petitioner.
3. In view of the said submission, the 5th respondent is directed to receive the document submitted by petitioner for registration, if the same is presented before him within two (02) weeks from today, and if the 5th respondent does not wish to register the said document, he shall pass a reasoned order under Section 71 of the Act setting out the reasons why he does not want to register the said document and communicate it to the petitioner within two (02) weeks from the date of submission of the said document by petitioner.
4. The Writ Petition is disposed of with the above directions. No
costs.
5. As a sequel, miscellaneous petitions pending if any, in this Writ Petition shall stand closed.
