THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION NO.7996 OF 2017 ORDER:

Petitioner, who is A9 in Cr.No.293 of 2017 on the file of Station House Officer, Gadwal Town Police Station, Jogulamba Gadwal District, registered for the offences punishable under Sections 3 and 4 of Telangana Gaming (Amendment) Act, 2017, filed this petition under Section 438 Cr.P.C. seeking anticipatory bail.

Learned counsel for the petitioner submitted that the petitioner was falsely implicated in this case. Learned Additional Public Prosecutor representing the State submitted that the petitioner along with other accused are involved in cricket betting.

The case of the prosecution is that on 11.08.2017, the Sub Inspector of Police, Gadwal Town P.S. raided flat No.203, Venu Apartments, Venu Colony, Gadwal, and seized cell phones. After completing the necessary formalities, police registered the above case. 4.

A perusal of the record reveals that A1 to A4 are conducting online cricket betting in Gadwal town on commission basis. A perusal of the record prima facie reveals that the petitioner herein along with other accused are involved in the cricket betting on online. A perusal of the record reveals that A8, A10, A12, A14, A15, A20, A21, A24, A25, A31, A33, A37, A58 and A95 were arrested on different dates. A perusal of the record prima facie reveals the role played by the petitioner in the commission of offence. 5.

While deciding this type of cases, the Court has to take into consideration the impact of the offence on the

society as well as pathetic condition of the family members of the accused.

Taking into consideration the nature of the offences alleged to have been committed by the petitioner and the stage of investigation, I am of the considered view that it is not a fit case to grant bail to the petitioner at this stage.
