THE HONOURABLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.10259 of 2016 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/accused Nos.2 & 3 seeking to quash the C.C.No.369 of 2014 on the file of the XV Additional Chief Metropolitan Magistrate, Hyderabad, for the offences under Sections 498-A, 406 and 506 I.P.C. and Sections 3 and 4 of Dowry Prohibition Act.
Heard the learned counsel for the petitioners/accused Nos.2 & 3 and the learned Public Prosecutor and perused the material available on record.
It is brought to the notice of this Court that during the crime stage, Criminal Petition No.6161 of 2014 was filed by petitioners along with other accused and this Court disposed of that Criminal Petition by order dated 10-06-2014 directing the Police to proceed with investigation and petitioner Nos.2 to 4 therein - accused Nos.2 to 4 were permitted not to appear before the Police or Court till the completion of investigation. In that view of the matter and since charge-sheet has been filed and pending for the last more than two years, learned trial Court is directed to dispose of C.C.No.369 of 2014 as expeditiously as possible, preferably within a period of six months from today, but, however, without insisting the presence
of petitioners - accused Nos.2 & 3 on each and every hearing before the trial Court, but petitioners - accused Nos.2 & 3 shall appear before the trial Court when the trial Court insists for their appearance for any specific purpose.
Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending in this petition, if any, shall stand closed.
