HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No. 1758 of 2018 ORDER:

The present Writ Petition is filed seeking the following relief:

" issuance of writ of mandamus declaring the action of the second respondent in issuing Enquiry Notice Rc.No.D3/ 2356/ 2017-37, dated 29.11.2017, calling upon the petitioner to re-establish his claim of Local Scheduled Tribe Certificate in terms of G.O.Ms.No.3, Social Welfare (TWEDN.II) Department, dated 10.01.2000, though the same was held to be genuine vide proceedings issued by the fourth respondent in Rc.No.D3/ 1949/ 2013 dated 22.07.2014 and the proceedings issued by the fifth respondent vide Rc.No.K/ 2006/ 2013, dated 18.11.2013, as illegal, arbitrary and without jurisdiction and to set aside the Enquiry notice dated 29.11.2017."

2. Heard learned counsel appearing for the petitioner and the Government Pleader for Social Welfare.

The case of the petitioner is that vide notice dated 29.11.2017, the petitioner was directed to appear before the Chambers of the Joint Collector, Bhadradri Kothagudem, for verification of the certificates of the petitioner pertaining to Scheduled Caste, since a doubt was expressed by the employer of the petitioner. The petitioner instead of appearing before the Joint Collector, has filed this present Writ Petition in the month of

January, 2018 and till date there is no interim order. Since the cause of action by efflux of time has expired in the month of November, 2017, nothing survives for adjudication in this Writ Petition.

4. Accordingly, the Writ Petition is dismissed as infructuous. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand dismissed. No order as to costs. __________________ T. AMARNATH GOUD, J 01.05.2019 gkv
