THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18553 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an appropriate Writ, Order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent issuing the proceedings in BA.No.1086/1297/B/Z5/CDA/2016, dated 30.12.2016 which was served on 7.1.2017 is highly arbitrary, illegal, unjust and unconstitutional and violation of principles of natural justice and consequently set-aside the same and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice."

Learned counsel for the petitioner contended that pursuant to the notice, dated 30.12.2016, of respondent No.2, the petitioner submitted her explanation and also complied with all the conditions imposed by the respondent authorities and the same was also allowed and hence, prays to give a direction to respondent No.2 to consider the representation, dated 20.04.2017, of the petitioner and pass appropriate orders in accordance with law. 3.

Learned Standing Counsel appearing for respondent No.2 submitted that if the petitioner complies with all the legal formalities as per the rules and regulations of the Hyderabad Municipal Corporation Act, 1955, respondent No.2 will certainly consider the aforesaid representation of the petitioner.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.2 is hereby directed to consider the representation, dated 20.04.2017, of the petitioner and pass appropriate orders in accordance with law as expeditiously as possible provided the petitioner complies with all the conditions imposed by the respondent authorities.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
