THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.8975 of 2017 ORDER:

Petitioner raised an industrial dispute aggrieved by the order dt.25.02.2006 imposing punishment of deferment of two annual grade increments with cumulative effect. 2.

The Labour Court by award dt.01.11.2013 made in I.D.No.73 of 2012 modified the punishment to without cumulative effect and the respondent-corporation was directed to release the increments after the punishment is undergone.

Petitioner seems to have submitted a representation on 21.02.2014 to release the increments after the expiry of the period of punishment. Aggrieved by the inaction on the representation submitted and not releasing the increments, this Writ Petition is filed.

Since the petitioner contends that representation was already submitted and the same is not disposed of, I am not inclined to keep the writ petition pending.

Therefore, the Writ Petition is disposed of at the admission stage directing the Regional Manager(2nd respondent) to examine the claim of the petitioner for release of increments after completion of punishment as submitted in his representation dt.21.02.2014 and pass orders as

warranted by law assigning due reasons in support of the decision and communicate the same to the petitioner, within a period of six (06) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. 6.

Consequently, miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
