2017-04-11A Ramalingeswara Rao2 pages

HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.9637 of 2017

ORDER

Challenging the action of the 3rd respondent in calling the petitioners to the police station and harassing them in connection with the complaint given by the family members of the 4th respondent, the present writ petition is filed. Learned Government Pleader for Home, produced the written instructions received from the 3rd respondent, wherein it is stated as under:

"It is submitted that basing on the complaint of the 4th respondent herein, a case in Cr.No.162/17, dt.16.3.2017, u/s.498-A IPC & Sections 3 and 4 of Dowry Prohibition Act, 1985 was registered on the file of the 3rd respondent police station against the petitioners herein. During the course of investigation (5) witnesses have been examined and Notice u/s.41-A Cr.P.C was served on the petitioners 1 & 2 herein, accused Nos.1 & 2, on 20.3.2017. Further investigation is in progress. In view of the above facts, it is submitted that allegations of the petitioners against the respondent police authorities are totally false and baseless. There is no truth in the contention of the petitioners that the 3rd respondent police have been calling the petitioners to the police station all the time without any reasons and harassing the petitioners on the complaint of the 4th respondent and her family members."

In view of the aforesaid averments, the Writ Petition is closed. No costs.

Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 11th April, 2017 rkk
