HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 27572 of 2011 ORDER:
As there was no representation on behalf of the petitioner on 06.07.2015 and 07.07.2015, the matter was listed to today under the caption "for dismissal". Even today also there is no representation on behalf of the petitioner either in the morning or in the afternoon session. It appears that the petitioner is not interested in pursuing the petition.
Apart from that, a perusal of the material on record would show that the present writ petition came to be filed stating that the petitioner is the legal heir and successor of Nawab Naseer Yar Jung, who was the pattedar and possessor of lands covered in Sy.Nos. 311/1, 311/1A, 311/2, 312, 313, 314, 315/1 and 315/2 situated at Karmanghat, Saroornagar Mandal, Ranga Reddy District.
It is stated that while the writ petitioner was in possession of the land, the revenue officials in collusion with Syed Abdul Rehman and others, got their names entered in the revenue records as pattadars and possessors of the said land. On coming to know about the same, the petitioner obtained copy of order and filed appeal before the respondent on 05.05.2010. It is stated that inspite of his repeated requests, the respondent did not take any steps for disposal of the appeal. It is stated that the persons, whose names were entered in the revenue records are taking advantage of the same and are trying to hypothecate the said lands in a Bank. Hence, the present writ petition is filed. The Government Pleader on instructions submits that on
14.07.2010 the Joint Collector passed final orders in the appeal directing the petitioner to approach the civil Court since there is a dispute in the title.
In view of the above, the writ petition is liable to be dismissed and the same is accordingly dismissed, leaving it open to the petitioner to avail the remedies available under law. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
