K. Muthyam Reddy, S/O. Late Venkat Reddy v. The State Of Telangana,
The Hon'ble Sri Justice C.V.Nagarjuna Reddy Writ Petition No.40199 of 2015 Date: 11.12.2015 Between:
K.Muthyam Reddy .. Petitioner and The State of Telangana rep. by its Prl.Secretary Revenue Department Hyderabad and 2 others .. Respondents Counsel for the petitioner: Mr.D.Jaganmohan Reddy Counsel for respondent No.1: AGP for Revenue The Court made the following:
O r d e r :
This Writ Petition is filed with the grievance that respondent Nos.2 and 3 have not been furnishing certified copies of the documents sought by the petitioner vide applications, dated 15.10.2014, 18.11.2015 and 26.11.2015.
On the petitioner's own showing, by Order, dated 09.09.2015, the XXIII Metropolitan Magistrate, Cyberabad, has summoned the very same documents, for supply of which the petitioner has approached respondent Nos.2 and 3.
In my opinion, when a judicial order summoning the subject documents was already passed by a competent Court of Law, the petitioner is entitled to seek enforcement of the same.
Therefore, the Writ Petition is wholly misconceived and the same is liable to be dismissed.
Accordingly, the Writ Petition is dismissed, however, with liberty to the petitioner to pursue his remedies before the XXIII Metropolitan Magistrate, Cyberabad.
As a sequel to dismissal of the Writ Petition, WPMP.No.51902 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 11th December, 2015 lur
