HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.17256 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties.

The petitioner was appointed as a fair price shop dealer of shop No.27, Mulukuduru Village, Ponnuru Mandal, Guntur District subsequent to the death of his father. The third respondent issued show cause notice dated 17.07.2013 to the petitioner alleging two irregularities and suspended his authorization until further orders. The fourth respondent filed a case under Section 6-A of the Essential Commodities Act, and the said case is stated to be pending. When the third respondent did not complete the enquiry initiated, pursuant to the show cause notice, till today, the present Writ Petition is filed. It is clear from the papers, filed along with the Writ Petition, that an order of suspension of authorization was passed on 17.07.2013 until further orders. The petitioner submitted his explanation on 06.08.2013. In spite of the same, the third respondent has not completed the enquiry pursuant to the allegations levelled against the petitioner.

In the circumstances, the third respondent is directed to complete the enquiry, duly observing the principles of nature justice, and pass final orders, within a period of thirty days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of at the stage of admission. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
