HCJ & AAR, J Dt: 24-12-2019 Judgment: (per Hon'ble The Chief Justice Sri Raghvendra Singh Chauhan) The appellant-husband has challenged the legality of the judgment and decree dated 31-01-2014, passed by the Senior Civil Judge, Jangaon, whereby the learned Judge has allowed O.P. No. 28 of 2009, filed by the respondent-wife for restitution of conjugal rights, and dismissed another petition, namely H.M.O.P. No. 15 of 2010, filed by appellant-husband for grant of divorce. Aggrieved by the said common order, the appellant has filed the present appeal, and another appeal, namely C.M.A. No. 543 of 2014. However, during the pendency of the appeals, the parties have entered into a compromise. In C.M.A. No. 543 of 2014, they have filed an application under Section 13-B of the Hindu Marriage Act, 1955 (for short 'the Act'), which has been allowed today by this Court.

In the light of the divorce granted on the basis of mutual consent under Section 13-B of the Act, this appeal stands disposed of.

As a sequel, miscellaneous petitions, pending if any, stand dismissed as infructuous.
