THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.21786 of 2006 ORDER:
Heard learned counsel for the petitioners and Sri B. Narayana Reddy, learned Assistant Solicitor General for the first respondent, and learned Government Pleader for Revenue for the third respondent.
According to the petitioners, they participated in the liberation struggle for merger of Hyderabad State into Indian Union. The Union of India, with a laudable object of safeguarding the evening lives of freedom fighters, introduced Swatantra Sainik Samman Pension Scheme, 1980. In terms of the said Scheme, the petitioners claim to have made applications to the Union of India on 01.07.1997. In order to demonstrate that the said applications were made by the petitioners to the Union of India, acknowledgments have been filed along with the writ petition as material papers.
During the course of hearing, it is submitted by Sri B. Narayana Reddy, learned Assistant Solicitor General for Union of India, that unless the Union of India receives verification report from the State Government, no action can be taken and as per the procedure contemplated under the Scheme, the applications need to be submitted to the Chief Secretary of
AVSS, J W.P.No.21786 of 2006 the State Government/Union Territory concerned and a copy should also be sent to the Deputy Secretary, Government of India.
In the instant case, there is no dispute with regard to the submission of applications to the first respondent. At the hearing, it is submitted by the learned counsel for the petitioners that copies of the applications and the documents filed by the petitioners before the Union of India would be submitted to the State Government, and a request is made by the learned counsel to direct the third respondent - State Government to take appropriate action on the said applications by fixing some timeframe.
This Court considers the said request as genuine and reasonable.
For the aforesaid reasons, the writ petition is disposed of, keeping it open for the petitioners to submit copies of the applications, along with necessary documents, to the State Government within a period of three months from today. If any such applications along with the material are submitted within the time stipulated, the same shall be considered and appropriate action be taken by the third respondent - State Government for sending verification report to the Union of India in accordance
AVSS, J W.P.No.21786 of 2006 with law, within a period of three months thereafter. After receipt of the verification report, if any, the Union of India shall take appropriate action in accordance with law, within a period of three months thereafter.
Consequently, Miscellaneous Petitions, if any pending in this Writ Petition, shall stand closed. No order as to costs. _________________ A.V.SESHA SAI, J 18th JULY, 2017.
