G.Kalivara Prasad v. The Satte Of Telanagana
SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.6 0 9 of 2 0 1 8 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A1, in Crime No.145 of 2017 on the file of T.Sandole Police Station, Guntur District. The offences alleged are under Sections 409 and 468 r/ w 34 IPC.
2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.
3.
The public prosecutor brings to the notice of this Court, that earlier this petitioner has filed a criminal petition seeking for anticipatory bail, which was dismissed by this Court, by virtue of order dated 03.01.2018 in Crl.P. No.12649 of 2017. 4.
A perusal of the order shows that the petition was dismissed by considering the matter on merits and observing that the investigation would be hampered if bail is granted to the petitioners.
5.
Learned Public Prosecutor submits that the investigation is not yet completed.
6.
In the above circumstances, the nature of the offences does not entitle the petitioner for an anticipatory bail. Hence, this court opines that this is not a fit case for granting anticipatory bail.
7.
With the above observations, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
