Kaka Bhoja Rao Alias Bhujanga Rao v. The State Of Telangana

HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.3673 OF 2019 O R D E R:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of mandamus declaring the action of the 3rd respondent herein in openly supporting the case of the 4th and 5th respondent herein under the influence of 6th respondent and without hearing the petitioner herein in proceeding Rc.No.E/952/2018 is wholly illegal arbitrary and contrary to the procedure and to pass such other relief or reliefs as this Honble Court deems fit and proper in the circumstances of the case."

It is however relevant to note that after institution of this Writ Petition, the existing Jayashankar-Bhupalapally District in the State of Telangana was bifurcated and a separate district - Mulugu District was formed. Admittedly, the revision filed by the petitioner pertains to the newly formed Mulugu District and the third respondent, in the capacity of being the Joint Collector of Jayashankar-Bhupalapally District, would no longer have jurisdiction to deal with the said revision. The grievance of the petitioner with regard to the manner in which the third respondent was dealing with his revision therefore does not survive for consideration at this stage.

The Writ Petition is accordingly dismissed leaving it open to the petitioner to take steps in the event a fresh cause of action arises. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
