HON'BLE SRI JUSTICE U.DURGA PRASAD RAO SECOND APPEAL No.130 of 2017 JUDGMENT:
The Second Appeal is filed against the decree and judgment in A.S.No.117 of 2014 on the file of III Additional Chief Judge, City Civil Court, Hyderabad, dismissing the appeal by confirming the judgment in O.S.No.
of on the file of VII Senior Civil Judge, City Civil Court, Hyderabad, whereunder, learned Judge decreed the plaintiff's suit for eviction of the suit premises. Thus, the defendant is the appellant in the Second Appeal. 2.
Heard Sri E.V.V.S.Ravi Kumar, learned counsel for appellant and Sri Aadesh Varama, learned counsel appearing for respondent. 3.
Learned counsel for appellant, while filing an undertaking affidavit, would submit that there are no substantial questions of law involved in it and the appellant is ready to vacate the suit premises, but however, since he has been running a printing press in the suit schedule property, he requires a reasonable time of one year for vacating the premises which may be granted to him.

Opposing the same, learned counsel appearing for respondent would submit that on the aspect of vacating the premises, the matter has
UDPR,J SA NO. 130 OF 2017 been coming on since February 2017, and therefore, he is not agreeable for granting one year time from now, but time may be granted till the end of December 2017.

Both the learned counsel agreed for this course. 6.
In view of the above submission, while dismissing the appeal, time is granted to the appellant/defendant till 31.12.2017 to vacate the plaint schedule property. No costs.
