THE HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.14973 of 2009 ORDER :

This writ petition is filed seeking to issue a writ of Mandamus to declare the action of the respondents in not granting construction permission to the petitioner for construction of compound wall and shed in the land in Sy.No.124/H admeasuring 1080 square yards, situated at Hasanparthy Village, as illegal and arbitrary and consequently direct the respondents to grant construction permission to the petitioner to make construction of compound wall and shed in the land in Sy.No.124/H admeasuring 1080 square yards situated at Hasanparthy Village.

When the matter is taken up for hearing, it is represented by the learned counsel on either side that now the 2nd Respondent - Hasanparthy Grampanchayat is merged into Warangal Municipal Corporation.

3. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the petitioner to give a fresh application for construction permission along with all the relevant material for consideration of the concerned authority and on such

representation, the authority concerned is directed to consider the same as per the rules and regulations of the Municipal Corporations Act in vogue and pass appropriate orders. No order as to costs.
