HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO. 3990 OF 2015 O R D E R :
This writ petition is filed by the petitioner to declare the action of the respondents in interfering with the petitioner's peaceful possession and enjoyment of the property bearing D.No. 40-1-52/5, Mahatma Gandhi Road, Vijayawada and threatening him to compromise and extent the lease of the aforesaid property to the fourth respondent at his instance as illegal, without jurisdiction and in violation of Article 14, 19 [1] (g), 21 and 300-A of the Constitution of India and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.
2. Heard the learned counsel for the petitioner and the learned Government Pleader for Home [AP] appearing for respondents 1 to 3.

It is the case of the petitioner that the third respondent under the influence of the fourth and fifth respondents is interfering with the peaceful possession and enjoyment over the property bearing D.No. 40-1-52/5, Mahatma Gandhi Road, Vijayawada and threatening him to compromise with the fourth respondent and extend the lease of the aforesaid property to the fourth respondent at his instance.
4. Sri Ramesh Babu, Assistant Government Pleader for Home [AP] on the weightage of written instructions dated 23-2-2015
represents that there is no such unlawful interference of the third respondent and on the other hand, he submits that the petitioner is an accused in Crime No. 128 of 2015 registered for the offences punishable under section 149, 323, 454, 380 of IPC which was registered by the Station House Officer, Machavaram Police Station, Vijayawada city and the same is pending investigation.
5. In view of the same, the writ petition is dismissed. No costs.
6. As a sequel, miscellaneous petitions if any pending in this writ petition shall stand closed.
