The grievance of the petitioners is that their lands to an extent of Ac.08-70 cents in Sy.No.2/2, Ac.04-64 cents in Sy.No.4/1A, Ac.06-20 cents in Sy.No.5/1, Ac.07-20 cents in Sy.No.5/1 and Ac.07-48 cents in Sy.No.6/2 respectively situated at Banumukkula Village of Banaganapalli Mandal, Kurnool District for excavation of G.N.S.S. Flood Flow Canal and construction of CM and CD works (Gorakallu Reservoir to Owk Reservoir) and award was also passed on 05-08-2015. Thereafter, the petitioners made application for referring the matters for enhancement of compensation under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act (for short " the Act"). As no action has been taken, the present writ petition is filed.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Land Acquisition, who states that constituting of authority under Section 51 of the Act is under process. In view of the same, the respondent-government to constitute the authority under Section 51 of the Act within three months from the date of receipt of this order and respondents are directed to consider the application of the petitioner for referring the matter to the authority in accordance with law.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 13-07-2016 Nvl
