Heeralal v. State Of Telangana
SMT JUSTICE T.RAJANI CRIMINAL PETITION No.611 OF 2018 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.2, in Crime No.162 of 2017 on the file of the Station House Officer, Chilkalguda Police Station, Hyderabad City. The offences alleged are under Sections 454 and 380 of I.P.C. 2.
Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.
As per the case of prosecution, the allegation against this petitioner is that he purchased the stolen property from the other accused, who committed property offences.
4.
Learned counsel for the petitioner submits that the petitioner is an innocent person and he does not have any knowledge about the property which he purchased, whether it is stolen property or not. But the learned Public Prosecutor vehemently opposed the said contention, by drawing the attention of this Court to the earlier crimes in which he was figured as accused No.2 i.e., Crime Nos.43 of 2017, 407 of 2016, 95 of 2016 and 296 of 2017 on the file of the respective Police Stations. He further contends that the petitioner is a habitual offender and is in the habit of purchasing stolen properties from the other accused. 5.
Hence, in the above circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner/accused No.2 is directed to surrender the before the lower Court and obtain regular bail. The lower Court shall dispose of the bail application expeditiously, preferably on the same day, subject to pressure of other work.
TR,J Crl.P. No.611/2018 6.
Accordingly, with the above observation, the Criminal Petition is dismissed.
As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
