WRIT PETITION NOs.17135, 18578 & 19280 of 2009 COMMON ORDER:
Writ Petition No.20315 of 2003 filed by the original owners of land in Sy.No.210 of Kothapet Village, L.B.Nagar Municipality, Uppal Mandal, was allowed by this Court by judgment dated 28.03.2007 setting aside the orders of Special Court for Land Grabbing dismissing L.G.C.No.183 of 1996. In compliance of judgment in W.P.No.20315 of 2003, the order dated nil-06-2009 was issued directing petitioners to vacate the premises, which is impugned in these three writ petitions. These three writ petitions are filed alleging that without notices or opportunity to the petitioners straightaway an order of eviction and dispossession is made, causing grave hardship and suffering.
2. At the stage of admission, this Court granted stay against dispossession or demolition holding that without following due process of law, no adverse action should be taken against the petitioners. In compliance with the said direction of this Court, on 21.10.2009 notices were issued directing the petitioners to vacate the premises and hand over vacant peaceful possession so that the same can be handed over to the original owners of the land in accordance with the judgment rendered by this Court.
Aggrieved by the said notice, dated 21.10.2009, W.P.No.24580 of 2009 is filed jointly by all the petitioners in these three writ petitions. The said writ petition is disposed of by separate order. Since the objections of the petitioners in the writ petitions are complied with and notices were issued to them on 21.10.2009, which notices are challenged in W.P.No.24580 of 2009, cause in these writ petitions do not survive and writ petitions are liable to be dismissed.
3. These writ petitions are accordingly dismissed. There shall be no order as to costs. Miscellaneous petitions if any pending in these writ petitions shall stand closed.
