THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.982 OF 2024 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners - accused Nos.1 and 2 seeking anticipatory bail in the event of their arrest in connection with Crime No.13 of 2024 on the file of Station House Officer, Khairatabad Police Station, Hyderabad, registered for the offences punishable under Sections 341, 333 and 506 read with Section 34 of the Indian Penal Code (for short 'IPC').

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent - State and perused the record.

Briefly, facts of the case are that the de facto complainant who is working in the electricity department was went to record the meter reading, an altercation ensued and he was allegedly beaten up by these petitioners.

Learned counsel appearing for the petitioners would submit that the de facto complainant was in drunken state and abused the petitioners, for which reason the altercation ensued.

On instructions, learned Additional Public Prosecutor would submit that the victim was treated as out-patient. 6.

In the said circumstances, this Court is inclined to grant the relief of anticipatory bail to the petitioners - accused Nos.1 and 2 on the following conditions:

i) The petitioners - accused Nos.1 and 2 are directed to surrender before the Station House Officer, Khairatabad Police Station, Hyderabad on or before 05.02.2024. On such surrender, the said Station House Officer shall release them on bail, on their executing personal bonds for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for a like sum each to his satisfaction.

ii) On such release, the petitioners - accused Nos.1 and 2 shall appear before the said Station House Officer everyday for a period of ten days for the purpose of investigation and thereafter, as and when required.

iii) The petitioners - accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
