THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.10141 of 2004 ORDER:

This writ petition is filed under Article 226 of Constitution of India seeking a writ of Mandamus:- i) declaring the action of respondents in effecting the promotions to the post of Assistant Divisional Engineers, ignoring the seniority of the petitioners under the combined Seniority List of erstwhile APSEB, as illegal, arbitrary, contrary to the tripartite Agreement dated 25.4.1998 and Rule-7 of Electricity Reforms (Transfers Scheme) Rules, 1999; ii) Consequently, direct the respondents to effect the promotions as Assistant Divisional Engineers by operating the Combined Seniority List of Assistant Engineers prepared by erstwhile APSEB, and promote the petitioners as Assistant Divisional Engineers w.e.f. the date when their juniors in the Combined Seniority list of Assistant Engineers maintained by the erstwhile APSEB were promoted as Assistant Divisional Engineers, duly granting all other consequential benefits.

2. No representation on behalf of the petitioners on 03.6.2016. Today also, there is no representation on behalf of the petitioners in the forenoon and the afternoon. It appears that the petitioners are not interested to prosecute the writ petition. In that view of the matter, no purpose will be served by keeping the matter pending.

3. Hence, the writ petition is dismissed for default. Miscellaneous petitions if any pending in this writ petition shall stand closed. __________________________ (T.SUNIL CHOWDARY, J) June 06, 2016.
