THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4918 OF 2016 ORDER:

Sri Ghanta Rama Rao, learned Senior Counsel representing Sri Ghanta Sridhar, learned counsel for the petitioner, and Sri S. Lakshminarayana Reddy, learned Standing Counsel for the Greater Visakhapatnam Municipal Corporation, are in agreement that the issue arising in this writ petition is squarely covered by the decision rendered by this Court in W.P.No.38999 of 2015. A copy of the order dated 01.12.2015 passed in the said writ petition is placed on record.

For reasons alike as were stated in the afore-stated order and in terms thereof, the writ petition is disposed of directing the Greater Visakhapatnam Municipal Corporation to issue notice to the petitioner, consider his objections and thereafter take a decision as to the commencement of work. In the event the petitioner is aggrieved by the decision taken by the Corporation, he would be at liberty to avail appropriate remedies in accordance with law.
