HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.9469 of 2017 ORDER :
Heard merely because it is the submission that there is a counter case covered by Cr.No.309 of 2017 (present crime is 310 of 2017) registered for the offence punishable u/ sec.307 r/ w 34 IPC dt.28.08.2017 as counterblast to the present petition dt.26.08.2017 where the defacto-complainant herein is also A.1 among others.
In view of the above, this Court cannot go into the legality and correctness of the allegations of either of the report but for the matter requires investigation. Once such is the case, it is not even a case to invoke Section 41-A Cr.P.C.
Having regard to the above and in the result, the Criminal Petition is disposed of by left open all defences to the petitioners/ A.4 and A.8. The remedy of the petitioners available is to pursue for regular bail by surrender or anticipatory bail, as the case may be, before the appropriate Court of law. Consequently, miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
