HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 16384 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the inaction of the respondent in releasing annual increments, as illegal and arbitrary. A consequential direction is also sought to the respondent to release the above increments along with consequential benefits.

Heard Sri V. Narasimha Goud, learned counsel for the petitioner, and Sri N. Vasudeva Reddy, learned standing counsel for the respondent corporation.

It has been contended by the petitioner that he was appointed as Driver in the respondent corporation in the year 1986. While so, he has submitted resignation on 27.05.1996 and subsequently he has withdrawn his resignation. However, the respondent corporation has not allowed him to join duty. Challenging the action of the respondent, he filed W.P.No.5215 of 1997 and this Court granted interim direction to the respondent to take him into service vide orders dated 14.09.1998 in WPMP No.6218 of 1997, pursuant to which, he was allowed to discharge his duties from 23.04.1999 onwards. His grievance is that the respondent corporation is not releasing the increments only on the ground that he has filed the said writ petition against the corporation. Hence the present writ petition.

This Court having considered the said submission and perused the record is of the considered view that the writ petition can be disposed of with a direction to the petitioner to submit a representation to the respondent.

Accordingly, the writ petition is disposed of directing the petitioner to submit a representation to the respondent seeking to release annual increments within two weeks from the date of receipt of a copy of this order, and upon receiving such representation, the respondent shall consider the same and pass appropriate orders, in accordance with law, within four weeks thereafter. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 10th December, 2018 cbs
