HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.1794 of 2018 ORDER:
Heard learned counsel for the petitioner and also learned Government Pleader for Municipal Administration for respondent No.1 and by recording offer to file vakalat from the oral instructions by Sri Ashok Kumar, learned Standing Counsel for respondent Nos.2 to 4, by dispensing with notice to the unofficial respondent Nos.5 & 6 and from the perusal of the prayer in the writ petition with the supporting affidavit and other material on record including the representation of the petitioner to the respondent Nos.2 to 4 dated 19.12.2017 by furnishing his phone number also for contact to furnish the details therein.
The main grievance of the petitioner is that despite road is encroaching by the neighbours narrowing the same and preventing public access as a continuous nuisance, there is inaction of the respondents and the learned Standing Counsel for respondent Nos.2 to 4 now submits that they are going to take appropriate action according to law soon. Having regard to the above, the Writ Petition is disposed of with a direction to the official respondents to see that the road encroachment shall be removed in accordance with law preferably within four weeks from the date of receipt of this order, if necessary by demarcation of the private property and the road for the said purpose.
Dr. SSRB,J Consequently, miscellaneous petitions, if any shall stand closed. No costs.
