THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4384 OF 2016 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed by the Petitioner seeking to quash the proceedings in MC.No.28 of 2014 on the file of the Judge, Family Court, Khammam. Heard and perused the material available on record. The de facto complainant - 2nd respondent filed the MC against the petitioner seeking maintenance. Hence, this Court is not inclined to interfere with the further proceedings against the petitioner. After arguing for some time, learned counsel for the petitioner while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner before the trial Court.

In view of the submission of the learned counsel for the petitioner and considering the nature of allegations wherein the question of identity of the petitioner does not arise, his presence before the trial Court is dispensed with except on the dates of framing of charges, if any, examination under Section 313 Cr.P.C., and also on the date of pronouncement of judgment and the petitioner shall be properly represented by his counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions filed in this Criminal Petition, if any, shall stand closed. ______________ RAJA ELANGO, J March 30, 2016.
