THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2219 of 2019 O R D E R:

In this writ petition, petitioner challenges the seizure of his cell phone with No.9666010313 by respondent Nos. 2 and 3 in respect of Crime No.137 of 2018 on the file of Excise Police Station, Achampet.

There being no provision under the Andhra Pradesh Excise Act and the Rules made thereunder, the aforesaid cell phone shall be released to the petitioner. However, the respondents shall be at liberty to copy the call data of the subject cell if the same is required for the purpose of investigation. Subject to the above, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of.
