THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39294 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 2 and 3 in not providing police protection to the life and property of the petitioner on the report/representation dated 25.10.2016 in order to secure the compliance of the Judgment dated 06.09.2016 passed in O.S.No.37 of 2016 by the Hon'ble Court of Additional Junior Civil Judge-cum-XVII Metropolitan Magistrate, Cyberabad at Rajendranagar, as illegal and arbitrary, and consequently, to direct the respondents 2 and 3 to give police protection to the life as well as the property of the petitioner.
Heard and perused the material.
Learned counsel for the petitioner submits that though the petitioner made a representation dated 25.10.2016 to secure the compliance of the Judgment stated above, the respondents 2 and 3 are not providing police protection and as such, he seeks a direction to the respondents 2 and 3 to give police protection to the petitioner and his property. Considering the facts and circumstances of the case, the third respondent is directed to consider the representation dated 25.10.2016 submitted by the petitioner and provide police protection to the life and property of the petitioner if the third respondent is of the view that there is any necessity to provide police protection.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 15.11.2016 pln
