CONTEMPT CASE No.2294 OF 2015:
This Contempt Case is initiated suo motu by this Court since this Court noticed that the respondent, while passing order dt.8.11.2015 cancelling the petitioner's fair price shop dealership authorisation, ignored the order dt.31.8.2015 in W.P.No.27738 of 2015 which specifically directed him to consider the explanation of the petitioner in W.P.No.27738 of 2015 and the material produced by the said petitioner and pass orders.
2. Now, an affidavit has been filed by the respondent admitting that there was a lapse on his part on account of inadvertence and withdrawing the earlier order dt.8.11.2015 in Rc.D.858/2014, which is impugned in W.P.No.38346 of 2015, vide proceedings in Rc.D.858/2014, dt.18.2.2016. He has also tendered unconditional apology to this Court. Therefore, I do not wish to punish the respondent for contempt of Court. However, I want him to be careful in future.
3. The Contempt Case is, accordingly, closed. There shall be no order as to costs.
WRIT PETITION No.38346 OF 2015:
4. In this writ petition, the petitioner has questioned the proceedings dt.8.11.2015 issued by the Revenue Divisional Officer, Gudivada, Krishna District, on the ground that the said official has not considered the petitioner's explanation to the show cause notice while passing the said order.
Now, proceedings in Rc.D.858/2014 dt.18.2.2016 have been placed before me by the learned Government Pleader for Civil Supplies withdrawing the order dt.8.11.2015 in Rc.D.858/2014 passed by the said officer and restoring the petitioner's fair price shop dealership authorisation.
5. In this view of the matter, the cause in this writ petition no longer survives for adjudication. Therefore, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
6. Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
