THE HON'BLE SRI JUSTICE A.VENKATESHWARA REDDY CIVIL MISCELLANEOUS APPEAL No.438 of 2013 JUDGMENT:

None appears on behalf of appellants. Perused the proceedings dated 28.11.2022. On that day Ms.Sravani, Advocate on behalf of learned counsel for the appellants requested short time expressing personal inconvenience. Accordingly, though the matter was being listed under the caption 'for dismissal' for the last three hearings, on that day, it was adjourned to this day i.e., 12.12.2022 under the same caption with a condition that under no circumstances, any such representations will be entertained.

Hence, presence or representation on behalf of appellants is felt essential to proceed further.

Be it stated that this Civil Miscellaneous Appeal is pending since 2013. Therefore, in the above circumstances, I do not find any merit to adjourn the matter in the absence of proper representation. Accordingly, This Civil Miscellaneous Appeal is dismissed for default for non-prosecution.

However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
