This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by the petitioners/A.2 to A.5 seeking anticipatory bail in connection with Crime No.137 of 2025 of Easgaon Police Station, Komurambheem-Asifabad District. The offences alleged against the petitioners are under Sections 85, 108 and 80 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The case of the prosecution is that initially the complainant was lodged by the mother of deceased before police on 28.09.2025, wherein she that the deceased is her daughter and her marriage was performed with A.1 on 20.02.2025 in the presence of elders. On 28.09.2025 she received information from A.1 that her daughter committed suicide by hanging herself and immediately she went there and according to her, her daughter might have committed suicide due to ill-health or any other reasons, but she has not suspected A.1 or any of his relatives. Thereafter on 09.10.2025, the father of deceased gave complaint stating that his daughter committed suicide by hanging herself due to the harassment made by A.1 to A.5 for additional dowry. Hence, requested the police to take action against the accused. Basing on the same, the petitioners herein are also arrayed as accused.

Heard Sri D.Pochaiah, learned counsel appearing for the petitioners and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The contention of learned counsel for the petitioners is that petitioners are innocent of the said allegations. Initially there is no allegation against any of the accused. Later after
- 3 - discussing with the family members, the present complaint is registered against the petitioners and they are no way connected with the said allegations. Whatever allegations are made are only against A.1. A.1 is already arrested and released on bail. He further contended that petitioners are ready to cooperate with the investigating authority and custodial interrogation of the petitioners is not required. Hence, prayed this Court to grant anticipatory bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed bail contending that the allegations against the petitioners are severe in nature. Because of the harassment of A.1 to A.5 only, the deceased committed suicide. Therefore, petitioners are not entitled for bail at this stage and prayed to dismiss this petition.

Considering the submissions made by both the counsel and the material placed on record, the petitioners herein are A.2 to A.5. They are the parents and sisters of A.1. The record shows no allegations against these petitioners initially but after lodging the complaint on 09.10.2025, petitioners herein are arrayed as accused. Considering the allegations against the petitioners and the facts and circumstances, this Court deems it
- 4 - fit to grant anticipatory bail to the petitioners subject to the following conditions :
i.
The petitioners/A.2 to A.5 shall surrender before the Station House Officer, Easgaon, Kumrambheem-Asifabad District within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioners on bail on their executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties, for the like sum each.
ii.
The petitioners/ A.2 to A.5 shall appear before the concerned SHO between 09.00 a.m and 05.00 p.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation or till filing of charge sheet whichever is earlier and thereafter, as and when required.
iii.
The petitioners/A.2 to A.5 shall abide by the other conditions stipulated in Section 482 (2) of BNSS and co-operate with the Investigating Officer in investigating the case. 7.
Accordingly, the Criminal Petition is allowed.
Miscellaneous petitions, if any, pending shall stand closed.
