2019-04-03Challa Kodanda Ram2 pages

THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM W.P.Nos.2218 and 2242 of 2019 COMMON ORDER Since the similar issue is involved in both these writ petitions and the parties are also similar, they are being disposed of by this common order.

2.

These writ petitions are filed seeking to declare the action of the respondents in not disposing of the quarry lease applications of the petitioner firm for grant of lease of black granite in the subject lands, as illegal and arbitrary.

3.

The impleaded respondent opposed the writ petitions for grant of quarry lease in favour of the petitioner stating that there were rival claims with respect to the subject lands.

4.

Having regard to the respective claims and as it is the duty of respondents 1 to 3 to take a decision in accordance with the relevant rules, this Court is not inclined to entertain the writ petitions. However, it would be appropriate to direct respondents 1 to 3 to process the applications of the petitioner by considering the rival claims, if any, and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

5.

With the above direction, the Writ Petitions are disposed of. No order as to costs.

CKR, J W.P.Nos.2218 and 2242 of 2019 6.

Miscellaneous applications, if any pending in these writ petitions, shall stand closed.
