HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.1826 of 2018 ORDER:

Heard Smt.M.Shalini for petitioner, the Government Pleader for Co-operation and Sri N.Jayasurya for 4th respondent. The petitioner prays for the following relief :- " ....... to issue appropriate writ, order or orders more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in trying to retire petitioner at the age of 58 years is arbitrary, illegal and against the orders of the Honourable Apex court and relevant Government orders as illegal, arbitrary and unconstitutional consequently direct the respondents to continue the petitioner into service along with consequential benefits in the interest of justice....." . When the matter is taken up for hearing, learned counsel submit that similar issue was considered by the Division Bench in W.A.No.135 of 2018 dated 30.01.2018 and the Division Bench passed the following order:

" After hearing the learned Counsel for the parties, we are of the considered opinion that, if respondent Nos.1 and 2 consider the communication of respondent No.4 and come to the conclusion that the superannuation age of the appellants would be 60 years instead of 58 years, then they would be entitled for all consequential benefits." Hence, the writ petition is disposed of in terms of the order in W.A.No.135 of 2018 dated 30.01.2018. The interim order granted on 24.01.2018 is vacated. There shall be no order as to costs.
