HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18907 of 2016 ORDER:

This writ petition is filed with the following relief: "......Writ of Mandamus or any other Writ or order/direction to the 2nd respondent not to infringe liberty of the petitioner by detaining him and pass such further and other orders as may be found expedient under the circumstances."

Heard learned counsel for the petitioner as well as the learned Government Pleader for Home.

The learned Government Pleader for Home submits that since the petitioner is an accused in Crime No.113 of 2014 of Rajampet Urban Police Station, YSR Kadapa District, he is being summoned to the Police Station for the purpose of investigation.

Merely because the petitioner is an accused in Crime No.113 of 2014, it does not mean that he can be summoned to the Police Station frequently and detained in Police Station without there being any reason thereby infringing his rights.

In view of the facts and circumstances, this writ petition is disposed of directing the 2nd respondent - Station House Officer, Rajampet Police Station, Rajampet, YSR Kadapa District, not to summon the petitioner and

detain him in the Police Station, except in accordance with law. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
