2. Petitioner's grievance in this writ petition is that he was granted house site patta for Ac.0-05 cents in Plot No.23, situated in survey No.1076/4C, Macherla Revenue Village and Mandal, Guntur District. Alleging that the third respondent is seeking to cancel the said patta and dispossess the petitioner, the present writ petition is filed on the allegation that the third respondent is intending to cancel the said patta on the ground that petitioner has failed to utilise the land for the purpose for which it was allotted. Petitioner states that
due to ill-health and poverty, he could not construct the houses and also undertakes to construct the house within six months.
3. Learned government pleader has received instructions, which states that no revenue official has so far interfered with the peaceful possession of the petitioner over the above land and if any action is intended to be taken, due process of law will be followed.
4. In view of the same, therefore, writ petition is clearly based on apprehension and has no basis.
Writ petition is therefore disposed of directing the third respondent to follow due process of law if he intends to take any action against the petitioner. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
