THE HON'BLE JUSTICE SRI T. SUNIL CHOWDARY APPEAL SUIT No.1563 of 1999 JUDGMENT:

This appeal is filed under Section 96 of CPC, by the defendant, assailing the decree and judgment dated 31.3.1999 in O.S.No.235 of 1989 on the file of the Court of Principal Senior Civil Judge, Anantapur.

At the time of hearing, learned counsel for the appellant submitted that in spite of addressing a letter, the appellant did not turn up. It seems that the appellant is not interested to prosecute the appeal. In view of the same, no purpose will be served by keeping the appeal pending.

Hence, the appeal is dismissed for non-prosecution.

Miscellaneous petitions, if any pending in this appeal, shall stand closed.
