This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of the respondents in not considering the proposal, dated 31.10.2016, of the petitioner for recognition of Balaji College of Nursing, Madanapalli, Chittoor District, Andhra Pradesh for the academic year 2016-2017 as illegal and arbitrary and consequently, direct the respondents to enlist the Balaji College of Nursing, Madanapalli, Chittoor District in the list of Indian Nursing Council and for web counselling scheduled to be held in the second week of December, 2016 in the university of respondent No.2. 2.

Heard and perused the material available on record. 3.

The petitioner college was established in the year 2005 and started in the year 2006 after due inspection and permission from respondent No.1. Respondent No.1 conducted inspection in the college during the year 2015-2016 and pointed out some deficiencies vide letter, dated 10.5.2016, and after receipt of the list of deficiencies, the college has complied with all the deficiencies as per the list given by respondent No.1 by duly submitting a reply vide letter, dated 31.10.2016, and hence, prays to direct the respondents to enlist the petitioner College in the list of Indian Nursing Council and for web counselling scheduled to be held in the second week of December, 2016 in the university of respondent No.2.

Considering the facts and circumstances of the case and the grievance of the petitioner, this writ petition is disposed of with the following direction:

The petitioner is directed to file a representation to the Indian Nursing Council informing the grounds for recognition for the academic year 2016-2017 and on such representation, the Indian Nursing Council shall consider the same and pass appropriate orders in accordance with law. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
